A petition that addresses issues about marriage is known as a marital petition.  Consequently, marital petitions are any petition that addresses incidental or supplementary issues about marriage. Here are a few examples:

  • Divorce petition;
  • Spouce maintenance and/or child maintenance;
  • Request for child custody;
  • A judicial separation petition;
  • Request for restoration of marital rights;
  • A request to dissolve a marriage; etc.

Since it addresses the majority of issues resulting from a married relationship, family law in India is also known as matrimonial law. It is one of the most comprehensive areas of civil law, addressing a wide range of legal issues that somehow include families. It serves as the cornerstone of India’s family-related legal system, which addresses a wide range of topics and regulations impacting the lives of Indian residents and their families nationwide or internationally.

WHICH ACTS ARE COVERED UNDER THE FAMILY LAW

  1. The Hindu Marriage Act of 1955:
    It covers the majority of aspects of Hindu marriage and provides an essential basis for India’s family law. According to this law, there are specifics regarding the proper way to perform marriage ceremonies, the prerequisites for a legal union, and what spouses should and shouldn’t do. The statute also addresses concerns related to voidable marriages and monogamy and polygamy within Hindu marriages.
  1. The Hindu Succession Act of 1956
    is another important statute that regulates Hindus’ inheritance rights. In situations where an individual dies without leaving a will, this law specifies rules for allocating assets among surviving legal heirs. The Act gives daughters their portion of the family’s property, which is an important step in advancing gender equality in Hindu households.
  1. Special Marriage Act, 1954:
    This secular and all-inclusive legal framework in India permits individuals of various religious backgrounds or those who practice no religion at all to enter into civilly sanctioned weddings. An alternative to India’s religious marriage regulations that focus on interfaith or intercaste unions is offered by such an act.
  1. Apart from these there are other family laws for various religions like the Muslim Personal Law (Shariat) Application Act of 1937, Parsi Marriage and Divorce Act of 1936, Christian family law , etc.
